Introduction
NuraRx LLC (NuraRx, we, us, or our) owns and operates the NuraRx website, applications, member portals, intake systems, communication channels, and related services. These Terms govern your access to and use of the Services.
1. Services Overview
NuraRx provides an integrated care platform that may include AI-powered educational guidance, human coaching, care navigation, administrative support, intake processing, record collection, secure messaging, and access to independent licensed clinicians who may evaluate patients for treatment when clinically appropriate.
NuraRx itself is not a medical provider and does not practice medicine. Diagnosis, treatment, prescription decisions, and refill decisions are made by independent licensed healthcare professionals exercising clinical judgment.
2. Eligibility and State Availability
You may use the Services only if you are at least 18 years old, legally capable of entering into binding agreements, and located in a state where NuraRx and its clinical partners are authorized to operate. The Services are not intended for children.
Certain medications, services, or treatment options may not be available in all states. Availability may change based on clinical staffing and regulatory requirements.
3. No Emergency Care or Primary Care Replacement
The Services are not appropriate for emergencies and do not replace your primary care provider. Do not use SMS, email, portal messaging, coaching, or AI tools for urgent or emergency medical needs.
4. Telehealth and Clinician Review
Telehealth-related services may include electronic questionnaires, asynchronous messaging, audio or video visits, medical history review, laboratory review, prescription eligibility evaluation, and pharmacy coordination.
Clinician review and onboarding may take up to one week depending on intake completeness, lab availability, clinical review, pharmacy coordination, insurance requirements, and prior authorization needs. Some members may need additional documentation, labs, follow-up, waitlist placement, or prior authorization before any prescription decision is made.
5. Educational and Support Tools
Any educational or support tools made available through the platform do not diagnose, prescribe, or replace consultation with a licensed healthcare professional. Platform tools are not emergency services.
6. Prescription, Pharmacy, Labs, and Refills
Prescription medications are available only if determined clinically appropriate by a licensed clinician. NuraRx does not guarantee clinician approval, treatment, medication access, insurance coverage, prior authorization approval, medication availability, pharmacy inventory, shipment timing, or weight loss outcomes.
If prescribed, prescriptions are sent to a licensed pharmacy. Medication may be included in the displayed program price only where expressly stated; otherwise any pharmacy cost is disclosed before purchase. Pharmacy pricing, insurance coverage, supply, and shipping timelines vary. NuraRx does not operate a pharmacy.
Some prescription evaluations or refills may require current labs, recent records, follow-up assessments, or additional documentation. Refills are not automatic and require clinician approval.
Refill coordination and ongoing care navigation require an active treatment pathway and continued clinician approval.
7. Pregnancy, Breastfeeding, and Medical Appropriateness
Certain treatments may not be appropriate during pregnancy, while attempting to become pregnant, or while breastfeeding. You agree to provide accurate and complete health information so clinicians can evaluate safety and appropriateness.
8. Treatment Billing and Payments
Public treatment-pathway prices state the billing cadence, commitment period, services included, and whether medication and eligible lab services are included. Medication is included only when prescribed and only where the applicable price card states it is included.
Choosing a commitment option authorizes the amount disclosed at enrollment. Treatment, prescriptions, refills, insurance reimbursement, and medication availability are not guaranteed.
Any separate pharmacy, laboratory, shipping, insurance, or third-party cost will be disclosed when applicable before purchase.
9. Cancellation
You may cancel future renewals through your account settings or by contacting support before the next renewal date, subject to the commitment and refund terms displayed at purchase. Cancellation may end access to the NURA Care Companion, human coaching, care navigation, refill coordination, provider messaging, and platform features.
10. User Responsibilities
You agree to provide accurate, current, and complete information, protect your account credentials, follow clinician instructions, use medications only as prescribed, and use the Services lawfully. You may not share your account, provide false medical information, resell medications, harass staff, or interfere with platform security.
11. Communications and SMS Consent
SMS consent is optional, separate from general Terms acceptance, and is not a condition of purchase. If you opt in, you agree to receive SMS messages from NuraRx related to your account, intake, care coordination, reminders, and service updates. Message and data rates may apply. Message frequency varies. Reply STOP to opt out. Reply HELP for help.
SMS, email, portal messages, coach messages, and support messages are not monitored 24/7. Response times vary. Do not use messaging for emergencies.
Carriers are not liable for delayed or undelivered messages.
12. Privacy
Your use of the Services is governed by the NuraRx Privacy Policy and applicable privacy laws. Text messaging originator opt-in data and consent will not be shared with third parties or affiliates for marketing or promotional purposes.
13. Third-Party Services
NuraRx may use third-party pharmacies, laboratories, payment processors, communication providers, analytics providers, and telehealth infrastructure vendors. NuraRx is not responsible for third-party outages, delays, pricing, coverage decisions, inventory, or errors.
14. Disclaimers
The Services are provided as is and as available. NuraRx does not guarantee continuous access, error-free operation, specific health outcomes, prescription approval, medication access, prior authorization approval, insurance coverage, pharmacy availability, or weight loss results.
Individual results vary. Weight loss outcomes depend on adherence, medical history, nutrition, activity level, medication response, and other factors. No specific weight loss result is guaranteed.
15. Limitation of Liability
To the maximum extent permitted by law, NuraRx shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost data, service interruptions, pharmacy delays, supply-chain issues, or third-party decisions arising from use of the Services.
16. Indemnification
You agree to defend, indemnify, and hold harmless NuraRx, its affiliates, contractors, clinicians, officers, employees, and partners from claims arising from your use of the Services, violation of these Terms, misuse of medications, inaccurate information, or unlawful conduct.
17. Changes, Suspension, or Termination
NuraRx may update these Terms, change the Services, or suspend or terminate access for violation of these Terms, nonpayment, misuse, security concerns, operational reasons, or legal/regulatory requirements.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Disputes shall first be attempted to be resolved informally. If unresolved, disputes shall be resolved through binding individual arbitration except where prohibited by law.
